1. Introduction
These Terms and Conditions set forth the rules and guidelines governing the use of the services provided by Kenana Medical for coordinating, facilitating, and supporting medical tourism within the Arab Republic of Egypt. They also define the rights, obligations, and responsibilities of all parties involved.
By using the Company's services, website, completing a booking, or making any payment, the Client acknowledges that they have read, understood, and agreed to be bound by these Terms and Conditions. Such acceptance constitutes a legally binding agreement and shall have the same legal effect as a handwritten signature.
2. Nature and Scope of Services
Kenana Medical operates exclusively as a medical tourism coordination and facilitation company within the Arab Republic of Egypt. Its services may include:
- Recommending suitable physicians and medical facilities based on the patient's condition.
- Coordinating medical appointments and treatment procedures.
- Providing administrative and logistical case management.
- Arranging accommodation, transportation, and related services when agreed upon.
- Assisting with travel arrangements, airport reception, translation services, and other support services associated with the medical journey.
Kenana Medical is not a hospital, clinic, healthcare provider, medical facility, or travel agency, and does not directly provide any medical diagnosis, treatment, consultation, or healthcare services.
3. Medical Providers and Medical Responsibility
All medical services, including diagnoses, treatment plans, surgeries, medical procedures, consultations, and follow-up care, are provided exclusively by independent and duly licensed physicians and healthcare facilities.
The Client acknowledges and agrees that:
- The physician or healthcare facility bears sole responsibility for all diagnoses, treatments, and medical decisions.
- Kenana Medical does not participate in, supervise, control, or influence any aspect of medical care.
- Kenana Medical does not employ, supervise, or control any physician, surgeon, nurse, or medical facility involved in providing healthcare services.
- All risks, benefits, alternatives, and potential outcomes of treatment must be discussed directly with the treating physician.
Kenana Medical shall not be liable for the performance, actions, decisions, omissions, or conduct of any healthcare provider, nor for any medical outcomes or complications arising from treatment.
4. Pricing and Payment
Kenana Medical may manage payment arrangements through one of the following methods, depending on the nature of the case and agreements with healthcare providers:
- Facilitating direct payment between the patient and the healthcare provider without receiving funds.
- Receiving payment from the patient and transferring it to the healthcare provider on the patient's behalf, acting solely as a payment facilitator and coordinator.
In all cases, Kenana Medical acts solely as a payment coordinator and does not control the pricing, billing policies, or payment terms established by healthcare providers.
The Company shall not be responsible for any additional costs, including but not limited to:
- Post-operative medications.
- Additional medical procedures.
- Extended hospital stays.
- Any other fees determined by the healthcare provider.
All billing obligations and invoice adjustments remain the direct responsibility of the patient and the healthcare provider.
Notwithstanding the foregoing, certain medical programs or treatment packages may be subject to specific payment terms outlined in the proposal or agreement provided to the Client. The Client agrees to comply with the payment policy applicable to each program, which may require a deposit or a specified percentage of the program cost to be paid prior to arrival in Egypt, with the remaining balance payable in accordance with the stated financial terms.
All payments due to Kenana Medical must be made exclusively through the Company's authorized payment channels, including its website and any payment methods officially designated by the Company. Payments made through unauthorized channels shall not be recognized.
The Company reserves the right to suspend or cancel services if payment obligations are not fulfilled within the specified deadlines.
5. Cancellation and Refund Policy
Kenana Medical's coordination fees are non-refundable once service delivery has commenced, as such fees cover the time, resources, administrative efforts, and logistical arrangements required to organize the medical journey.
Any fees paid directly to healthcare providers—including physician fees, hospital charges, and medical procedure costs—shall be subject to the refund policies of the respective healthcare providers and are beyond the Company's control.
Kenana Medical shall not be responsible for refunding any amounts in cases involving medical complications, treatment cancellation, modifications to treatment plans, appointment changes, or where a patient is deemed medically unsuitable for a procedure.
Such decisions and any resulting financial consequences are solely determined by the independent healthcare provider.
6. Client Obligations
The Client represents and warrants that they shall:
- Provide complete, accurate, and truthful medical information and records.
- Disclose all relevant medical history, medications, allergies, and existing health conditions.
- Attend scheduled appointments on time.
- Follow all medical instructions and post-treatment care requirements.
- Obtain and maintain all necessary travel documents and visas.
The Client is also responsible for:
- Determining the suitability of the proposed treatment.
- Understanding the associated risks, benefits, and expected outcomes.
The Client must comply with all medical instructions and post-procedure care recommendations to minimize the risk of complications and optimize treatment outcomes.
The treating physician reserves the right to modify, postpone, or cancel any treatment plan or procedure based on the final medical evaluation upon the patient's arrival.
Kenana Medical reserves the right to modify or cancel a program if the information provided by the Client is found to be inaccurate, incomplete, or misleading.
Any losses, expenses, or costs arising from delays, no-shows, or inaccurate information shall be borne solely by the Client.
7. Accommodation, Travel, and Logistics
The Company may assist in arranging:
- Air travel.
- Hotel accommodations.
- Airport reception and transportation.
- Translation services.
- Local transportation.
- Tourism programs and supporting services.
These services are provided by independent third-party providers.
Kenana Medical shall not be liable for:
- Flight cancellations or delays.
- Visa denials.
- Travel disruptions.
- Hotel quality or service levels.
- Accidents or emergencies.
- Errors, omissions, or failures of third-party providers.
- Changes to schedules or appointments.
8. No Guarantee of Medical Results
Kenana Medical makes no representations, warranties, or guarantees regarding treatment outcomes, surgical results, success rates, recovery periods, or any medical result.
Medical outcomes vary from one patient to another depending on individual health conditions, treatment responses, and numerous medical factors.
Any estimates, projections, or information provided are for informational purposes only and shall not constitute an express or implied guarantee of any outcome.
9. Limitation of Liability
To the fullest extent permitted by applicable law, Kenana Medical shall not be liable for:
- Medical outcomes or complications.
- Failed treatments or procedures.
- Medical decisions made by healthcare providers.
- Any health-related, financial, psychological, or consequential damages.
- Travel, accommodation, or third-party service issues.
- Any indirect, incidental, special, or consequential losses arising from the use of the services.
The Client acknowledges that the Company's role is limited solely to coordination, facilitation, and administrative support.
10. Non-Circumvention
The Client agrees that all coordination related to medical services shall be conducted through Kenana Medical throughout the duration of the treatment program.
The Client further agrees not to enter into direct arrangements or circumvent the Company by dealing directly with physicians or healthcare facilities introduced through Kenana Medical during the service period.
11. Data Protection and Confidentiality
The Company may collect and process the Client's personal and medical information for purposes including:
- Medical coordination.
- Reservations and bookings.
- Follow-up communications.
- Delivery of requested services.
The Company is committed to maintaining the confidentiality of such information and shall only disclose it to healthcare providers or relevant parties to the extent necessary to perform the services or as required by law.
12. Force Majeure
The Company shall not be liable for any delay, cancellation, or inability to perform its obligations due to circumstances beyond its reasonable control, including but not limited to:
- Natural disasters.
- Epidemics or pandemics.
- Government actions or regulations.
- Border closures.
- Flight cancellations or delays.
- Visa denials.
- Any similar extraordinary circumstances.
13. Amendments to the Terms and Conditions
Kenana Medical reserves the right to amend these Terms and Conditions at any time. Any amendments shall become effective immediately upon publication on the Company's website or upon notification to the Client through available communication channels.
14. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Arab Republic of Egypt.
The Client agrees that any dispute, claim, or controversy arising out of or relating to the services or these Terms and Conditions shall be subject to the exclusive jurisdiction of the competent courts of Egypt.
